This is a brief run through of what the process looks like when you instruct us to draft a lasting power of attorney (LPA) for you.
Video consultation
The first step is a 30 minute video consultation with one of our qualified solicitors.
Our service includes both types of LPA - both the healthcare and the financial affairs LPA – and we’ll cover off the questions particular to each one on the call.
We’ll discuss what you might put in your ‘Preferences and Instructions’ so that the LPA reflects all of your wishes. We help you think through the possible scenarios, and the best way to deal with potential circumstances.
We’ll explain how your LPAs will be used and talk about who you might appoint as your attorneys. We’ll answer any questions you have at this stage and make sure you’re happy to proceed.
We hold our video calls on Zoom and you can join on your phone, tablet or computer. The Zoom call is very easy to join but if you have any questions we’re always on hand to help.
If both you and your partner have asked us to draft ‘mirror LPAs’ for you, we can have a joint call with you both present or separate calls. Whatever is most convenient for you.
Short questionnaire
After the call, we’ll send you a short questionnaire to capture the information we need. This will include things like the names of your attorneys, their addresses, and dates of birth. We’ll also ask you to provide information for any replacement attorneys and your certificate provider.
We draft your LPA
Next, we draft your LPA for you, in line with what we’ve learned from the initial call and your questionnaire. As your LPA is drafted by a qualified solicitor, you can be confident that it’s unambiguous, valid, and legally binding.
You review your LPA
We send your LPA to you through the post and by email. At this point, you should check it thoroughly to make sure it reflects your wishes, and nothing has changed since our first call.
If you have any questions, we’ll be happy to answer them. Equally if you need changes to be made, just let us know.
You sign the LPA
We’ll send you signing instructions when we send you your LPA to review. It’s important that you sign the document correctly, or it could be invalid. Our advice is to get everyone in the same room and sign it at the same time. The people you need to sign the LPA are:
- You
- Your attorneys
- Your replacement attorneys (if applicable)
- Your Certificate Provide
- Independent witnesses
Return the signed LPA to us for registration
Please return the signed LPA to us in the post. Once we’ve received it, we’ll give it one final check over and send it to the Office of the Public Guardian to be registered.
Your LPA must be registered in order for it to be effective and it can take 8-12 weeks for this to happen.
What does it cost?
We charge £295 for this service and there’s an additional cost of £82 per LPA for registration.
